Ascendants will be the forced heirs “legitimarios” if there are not any descendants. Their reserved share is half of the estate.
If there is a widow or a widower of the deceased, the reserved share of the ascendants is limited to a third of the estate.
The ascendants´ reserved share is divided in half between mother and father if they are still both alive. If only one survives, he or she will be the only legitimario and will be given the complete reserved share.
If there is no father or mother, but there are grandparents, the reserved share will be divided in half for each line if there are ascendants of the same grade in both lines. If the ascendants are of different grades, it will all go to the closest in grade.
